Emisary Terms and Conditions

Acceptance of Terms
By creating an account or using the Emisary website and services (“Emisary” or the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a binding legal agreement between you and Emisary (the “Company,” “we,” or “us”). If you do not agree with any part of these Terms, you must not use the Service. Your continued use of Emisary signifies your acceptance of these Terms. You also agree to our accompanying Privacy Policy, which outlines how we collect, use, and protect your data (including the practices described herein).
Eligibility
You must be at least 18 years old to use Emisary. By using or registering for the Service, you represent and warrant that you are 18 or older and capable of entering into a legally binding agreement. The Service is intended for personal self-improvement and entertainment use and is not directed to children.
Accounts and Registration
To access certain features, you will need to create an account with an email and password. Upon registration, Emisary will assign you an anonymous username. This username will be publicly associated with content you post, but it will not reveal your real identity. You agree to provide accurate and current information during registration and to keep your account credentials confidential. You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately. We are not liable for any loss or damage arising from unauthorized use of your account.
The Emisary Service
Anonymous Public Posting
By default, user submissions (Moments) are posted publicly under your anonymous username. Moments may appear briefly on a public feed or main page and then disappear from that feed. However, please note that these posts are not entirely ephemeral – they can still be accessed by others (for example, if someone views your profile or searches for your username or content). Do not share any content you wish to keep private. (Private posting options may be introduced in the future, but at launch all postings are public and anonymous.)
AI Analysis
Paying users (see Fees section below) can receive AI-driven analysis and feedback on each submitted Moment. The analysis is based on our proprietary personality affect system, aiming to help chart your evolving emotional and personality trends over time. Collective analysis of your submissions may be provided to give you insights into patterns and changes in your affect across multiple posts.
Availability
We will endeavor to keep the Service running smoothly, but we do not guarantee uninterrupted availability. There may be occasional downtime for maintenance, updates, or other reasons. We reserve the right to modify or discontinue any aspect of the Service at any time.
By using Emisary, you understand and agree that the Service and the AI analyses are provided for informational and entertainment purposes only. Emisary is not medical, psychological, or professional advice. Any insights or feedback are generated by an AI and should not be relied upon as a substitute for professional guidance. You remain solely responsible for your decisions and actions.
Paid Access and Fees
While certain basic features of Emisary are free to try, full access to AI analysis and advanced features requires a one-time paid access fee. By purchasing paid access, you agree to the following terms:
One-Year Access
Paid access grants you a membership to Emisary’s premium features for a period of one year from the date of purchase. This is not a subscription and will not auto-renew. After the one-year period ends, your premium access will expire unless you manually purchase another year of access.
Posting Limit
With an active paid membership, you may post up to 5 Moments per day (every day for the duration of your year) that will receive AI analysis. This limit ensures fair use of the Service for all users.
Included Features
The one-year access fee includes unlimited AI analyses for your allowed daily posts and any aggregate personality affect reports derived from your submissions over time. These features are provided at no extra charge beyond the initial fee. We may introduce additional premium features or services in the future, which could be subject to additional fees or terms, but they will be clearly communicated and optional.
Payments
Payments are processed through Stripe, a third-party payment processor. By providing payment information, you agree to Stripe’s processing of your payment and you are subject to Stripe’s Terms of Service and any applicable fees or policies. We do not store your credit card details on our servers. All fees are listed in U.S. dollars (unless otherwise specified) and are exclusive of any taxes or duties that may apply.
No Refunds
All purchases are final and non-refundable, except where required by law. Once you have paid for the one-year access, you will retain access to premium features for the duration of that period. If you choose to discontinue using Emisary before the year is up, or if your account is terminated due to a violation of these Terms, you will not be entitled to a refund for any unused time. In special circumstances (such as documented technical issues or billing errors), you may contact us to request a review, but we make no guarantee of refund outside of legal obligations.
Free Trial or Promotional Access
Emisary may offer a free trial period or promotional access to certain premium features at its discretion. Any such offers are subject to these Terms. We reserve the right to modify or terminate any free trial or promotion at any time. After a free trial ends, you will need to purchase the one-year access to continue accessing premium features.
User Content and Submissions
User Content
Emisary allows you to create and submit content in the form of textual posts (“Moments”) and potentially other media in the future. All content that you or other users submit, post, or display on the Service is collectively referred to as “User Content.” You are solely responsible for all User Content you submit and the consequences of posting it.
Public Posting and Anonymity
By submitting a Moment, you acknowledge that the content will be published publicly on Emisary under your anonymous username. While your real identity is not displayed, your submissions can be viewed by other users or visitors. We do not pre-screen User Content, and we are not responsible for the views or opinions expressed by users on the platform.
Ownership of Content
You retain copyright and ownership of the original text and content you submit to Emisary. Emisary does NOT claim ownership over the content you post. However, by submitting User Content, you grant us certain rights to use that content as necessary to provide and improve the Service:
License to Emisary: You hereby grant to Emisary a non-exclusive, worldwide, perpetual, irrevocable, unlimited, royalty-free, sublicensable license to host, use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content (in whole or in part) for the purposes of operating, improving, and promoting the Service, and for developing and refining Emisary’s AI analysis capabilities. This license includes the right for us to make your posts available to other users of Emisary, to display analysis or aggregated data derived from your content, and to use your content in any research or development of new features. This license will continue indefinitely (in fact, at any point forward or backward in time, and for as long as human consciousness in some form exists). In granting this license, you acknowledge that Emisary has the unlimited right to reproduce and use your anonymous submissions across time. This provision survives any termination of your account or of these Terms.
Use of Anonymous and Aggregated Content: When using or sharing your content, we will not disclose your personal identity without your consent. Any public use of user submissions (such as showcasing examples, trends, or aggregated insights) will be in an anonymous or de-identified form. We may analyze user submissions in aggregate to publish insights about personality affects, emotional trends, or other findings, but such publications will not identify individual authors. You agree that we may use your content and data in this way, and you waive any claims you might have against us for any moral rights or attribution with respect to your content as used in anonymized analyses or aggregated data sets.
No Third-Party AI Training Use: None of the content on this site (whether your own submissions or others’) may be used by any third party to train an artificial intelligence or machine learning model, other than Emisary’s own AI that is used for providing analysis as part of the Service. We do not authorize and expressly prohibit any data scraping or data usage of the content on Emisary for the purpose of developing or improving external AI systems. By using the Service, you agree you will not harvest or allow the harvesting of content from Emisary to train any AI outside of Emisary’s control.
Your Responsibilities: By posting User Content, you represent and warrant that: (i) you own or have all necessary rights, licenses, and permissions to submit the content and to grant the licenses to us as outlined above; (ii) your content does not infringe or violate the rights of any third party (including intellectual property rights, privacy rights, or any other legal rights); and (iii) your content and use of the Service complies with these Terms and all applicable laws.
We claim no responsibility or liability for User Content posted by you or any other user. The views expressed in User Content are those of the authors and do not necessarily reflect our views. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.
Acceptable Use and Content Standards
We want Emisary to be a constructive and safe environment for all users. By using the Service, you agree NOT to engage in any of the following prohibited activities and content:
Illegal or Harmful Content
Do not post any content that is illegal, promotes illegal activities, or could give rise to legal liability. This includes content that is threatening, harassing, defamatory, libelous, obscene, pornographic, or exploitative of minors. Content that incites violence or hatred, or that is discriminatory (e.g., racist, sexist, homophobic, or otherwise hateful toward any group) is strictly prohibited.
Personal Data and Privacy
Do not post personal identifying information (whether yours or others’) in Moments. Remember that all posts are public and anonymous — for your own privacy and safety, do not include information that could be used to identify you or anyone else (such as full name, address, phone number, email, etc.) in your submissions. Likewise, do not solicit personal information from other users.
Intellectual Property Infringement
Do not submit content that you do not have the right to use. This means no posting of content that infringes someone else’s copyright, trademark, or other proprietary rights. You should only post text (or other media) that you wrote or created, or that you have permission to use. If you quote or reference someone else’s work, give proper attribution and ensure it’s allowed.
Spam and Nonsense
Emisary is a platform for meaningful personal expression and reflection. Do not post spam, advertisements, or promotional content, and do not post “nonsense” or gibberish text. We reserve the right to remove or filter out content that is nonsensical, generated solely to game the system, or otherwise devoid of meaning relative to the platform’s purposes. Repeated posting of irrelevant or nonsensical content may result in suspension of your posting privileges.
Malicious Activity
Do not use the Service to distribute malware, viruses, or any other harmful code. Do not attempt to hack, overload, “scrape” (automated data collection), or otherwise interfere with the normal functioning and security of Emisary or users’ accounts.
Impersonation and Misrepresentation
You must not impersonate any person or entity or misrepresent your affiliation with any person or entity.
No Exploitation or Unapproved Use
You may not use the Service for any commercial purpose (other than for your personal self-improvement) without our express written permission. This includes no data mining, scraping, or using the platform’s content or AI outputs for building any product or service. Any attempt to reverse engineer our systems or to use our output to create competing services is prohibited.
Moderation and Enforcement
While Emisary does not generally pre-moderate User Content, we reserve the right (but do not assume the obligation) to review, monitor, and/or remove any User Content at our discretion. In particular, content that violates these Terms or is flagged by our systems as “nonsense” or spam may be removed without prior notice. We may also suspend or terminate accounts involved in severe or repeated violations (see Termination below). Users can report content they believe violates these standards, and we will review such reports and act as we deem appropriate. However, you acknowledge that given the real-time nature of the platform, we are not liable for any failure to remove or delay in removing any inappropriate content.
Payment Processing
All payments for Emisary’s services are handled through third-party payment processors (such as Stripe). By making a purchase on Emisary, you agree to the processing of your payment information by such third parties. We do not directly collect or store your sensitive payment details (like credit card numbers); instead, that information is provided directly to our payment processor, which is responsible for its handling and security.
You authorize us to charge your provided payment method for the one-time fee at the time you choose to upgrade to a paid one-year access. If there are any issues in billing or payment (such as a chargeback, dispute, or failed charge), we reserve the right to suspend or revoke your access to paid features until the issue is resolved. You are responsible for providing a valid payment method and resolving any payment problems. Any fees charged by Stripe (or your bank, etc.) in connection with the payment (for example, transaction fees, foreign exchange fees) are your responsibility.
Please note that when making a payment, you may be subject to Stripe’s user terms and privacy policy. We have no control over and are not responsible for the actions of Stripe or any third-party payment provider. If you have issues with payment processing, you may need to contact the payment provider for support, although we will try to assist where possible.
Privacy and Data Usage
Your privacy is important to us. Emisary’s Privacy Policy (available on our website) explains in detail how we collect, use, store, and protect your personal data and submissions. The following is a summary of key practices relevant to these Terms:
Data Collection
When you use Emisary, we collect certain information from you, including the content you submit (your Moments), and basic account information like your email (for account management and communication). We may also collect technical information (such as IP address, browser type, and cookies) as described in our Privacy Policy to improve your experience and for security/logging purposes.
Use of Submissions for AI Training
By using Emisary, you acknowledge that we will store your submissions and may use them to train and improve our AI algorithms. This means your posts might be analyzed in combination with others’ posts to refine our personality affect analysis system. Such training will be solely for the purpose of improving the Service’s feedback quality. As stated above, we will not associate your real identity with your content in this process, and any analysis or model improvements will not publicly reveal your personal information.
Account Data and Anonymity
Your account is designed to keep you anonymous to other users. We keep your email address private and only use it for account verification, password resets, customer support, and essential notifications. We do not sell your personal data to third parties. If we ever publish overall findings or research based on user data, it will be in an aggregated and anonymized form (with no personally identifying information).
Data Security
We implement industry-standard security measures to protect your data. However, no system can be 100% secure, so we cannot guarantee absolute security. You are responsible for maintaining the secrecy of your login credentials. Please notify us immediately if you suspect any unauthorized access to your account.
Retention and Deletion
We retain your User Content and data on our servers for as long as your account is active, as it is needed for providing the Service (including generating your personal affect analysis over time). You have the right to request deletion of your account and all associated data at any time. If you request account deletion (or if we delete an account due to inactivity or violation), we will permanently delete or anonymize your personal data and submissions from our live databases, so that they are no longer accessible. Keep in mind that removal from backups or cache may not be immediate, but we will strive to ensure your data is fully expunged. Once an account is deleted, this action is irreversible – you will no longer be able to recover the account or any content associated with it.
Data Portability
We plan to offer tools for you to download or export all your submissions and related data for your personal use. While this feature may not be available at launch, it is part of our roadmap. In the meantime, you may contact us for assistance if you wish to obtain a copy of your data, and we will do our best to help you. By using the Service, you acknowledge that this feature is forthcoming and not currently guaranteed.
Third-Party Services
Aside from Stripe for payments, Emisary does not actively share your personal data with third-party service providers, except as necessary for operating the Service (for example, cloud hosting, email service for communications, analytics tools) and as detailed in our Privacy Policy. Any third-party services we utilize are bound by obligations to protect your data, and we do not permit them to use your data for any purposes other than providing services to us.
If you have questions about privacy or data practices, please refer to our Privacy Policy or contact us via the information provided at the end of these Terms. By using Emisary, you consent to the collection and use of information as outlined here and in the Privacy Policy.
Account Termination and Deletion
By You (Voluntary Deletion)
You may terminate your account at any time if you no longer wish to use Emisary. You can do this by contacting our support team or using any account deletion function we provide. Upon verifying your request, we will deactivate and delete your account. As noted in Privacy and Data Usage, this will result in the permanent deletion of your submissions and personal data from our systems (subject to any retention required for legal compliance). If you delete your account, you understand that you will lose access to any content or data associated with it (including any accumulated analysis or remaining paid access time), and you will not be entitled to any refund for any remaining period of membership.
By Us (Termination for Cause)
We reserve the right to suspend or terminate your account, or restrict your access to parts of the Service, at our sole discretion, if we believe you have violated these Terms or otherwise engaged in behavior that harms the Service or other users. For example, violations of the Acceptable Use policy, unlawful behavior, or abuse of the platform can result in immediate termination or suspension. We may also terminate accounts that are inactive for an extended period or if required by law to do so. Where reasonable, we will attempt to notify you of the violation and allow you to correct it, but we are not obligated to provide notice or opportunity to cure before termination, especially in severe cases.
Effect of Termination
Upon termination (by you or us), your right to use the Service will cease immediately. We will remove or disable access to your content as described above. Sections of these Terms that by their nature should survive termination (such as content license granted to us, disclaimers, indemnities, and limitation of liability) will continue to apply even after your account is terminated or these Terms end.
We are not liable to you or any third party for termination of your account or access to the Service, or for deletion of your content, provided such termination or deletion is in accordance with these Terms. If your account was terminated by us and you believe this was in error, you may contact us to appeal, but we make no guarantee of reinstatement.
Intellectual Property Rights (Emisary Materials)
All rights, title, and interest in and to the Emisary Service, including the software, algorithms (including the Emisary personality affect system and any AI models), design, logos, trademarks, text (other than User Content), graphics, and all other content or materials created or provided by us (“Emisary Materials”), are owned by or licensed to the Company and are protected by intellectual property laws. Emisary retains all rights in the Service and Emisary Materials that are not expressly granted to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Emisary Service and Emisary Materials for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of our proprietary materials, nor may you reverse engineer or attempt to extract the source code of any software, algorithm, or AI model, except to the extent laws expressly permit despite this limitation.
You acknowledge that “Emisary” and associated logos and slogans are trademarks or service marks owned by us. You are not permitted to use these marks (or any similar marks that may cause confusion) without our prior written approval. Likewise, any feedback, comments, or suggestions you may provide regarding Emisary are entirely voluntary, and we are free to use them without any obligation or compensation to you, and without restriction.
If you believe that any content on Emisary (including User Content posted by others) infringes your copyright or other intellectual property rights, please notify us in writing with details (for example, under the Digital Millennium Copyright Act (DMCA) if applicable) so that we can investigate and respond appropriately, including removal of the infringing material if warranted.
Disclaimer of Warranties
Emisary is provided on an “AS IS” and “AS AVAILABLE” basis. Your use of the Service is at your own risk. To the fullest extent permitted by law, Emisary (the Company), and its officers, directors, employees, and agents, disclaim all warranties and representations, express or implied, regarding the Service and its content. This includes, but is not limited to, any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We specifically do not guarantee that: (i) the Service will meet your requirements or expectations; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) any results, analyses, or insights that may be obtained from the use of the Service will be accurate or reliable; or (iv) any defects or errors in the Service will be corrected. While we strive for insightful and meaningful AI analysis, we make no warranty that the AI’s output is correct, accurate, or tailored to your personal circumstances. The AI analysis is probabilistic and for informational purposes – you should not rely on it as authoritative guidance for personal decisions.
No advice or information (whether oral or written) obtained from Emisary or through the Service shall create any warranty not expressly stated in these Terms. We do not warrant that the site, servers, or any emails sent from us are free of viruses or other harmful components. You are responsible for implementing precautions to protect your devices and data from harm.
Because some jurisdictions do not allow the exclusion of certain warranties, some of the above exclusions may not apply to you. In such case, any implied warranties are limited to the minimum scope and duration permitted by applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, under no circumstances will Emisary or its parent, affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, or exemplary damages (including but not limited to damages for loss of profits, goodwill, data, or other intangible losses), arising out of or relating to your access to or use of (or inability to use) the Service or any content on the Service, even if we have been advised of the possibility of such damages.
In particular, we shall not be liable for: (i) the cost of procurement of substitute goods or services; (ii) any unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party (including other users) on the Service; (iv) any content obtained from the Service (including any reliance on its accuracy or reliability); or (v) any other matter relating to the Service.
To the extent we are found liable for any claim, our aggregate liability to you for all claims arising out of or related to the Service or these Terms shall not exceed the amount actually paid by you to us for the Service in the 12 months preceding the claim (or, if greater, fifty U.S. dollars (USD $50)). This limitation applies to any and all claims, whether based on warranty, contract, statute, tort (including negligence), or any other legal theory.
Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so some of the above limitations may not apply to you. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
You acknowledge and agree that the limitations of liability and disclaimers of warranty provided in these Terms are material, bargained-for bases of this agreement, and that we have set our pricing and offered access to the Service in reliance on these provisions.
Indemnification
You agree to indemnify, defend, and hold harmless Emisary and its officers, directors, shareholders, employees, contractors, agents, and affiliates, from and against any and all claims, suits, actions, demands, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable attorneys’ fees) arising from or related to: (i) your use or misuse of the Service; (ii) any User Content you submit, post, or transmit; (iii) your violation of any term of these Terms; (iv) your violation of any third-party right, including without limitation any intellectual property, confidentiality, property, or privacy right; or (v) any claim that your content caused damage to a third party.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You may not settle any such claim without our prior written consent. This indemnification obligation will survive the termination of your account and these Terms.
Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to these Terms or the use of the Service will be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding between you and Emisary related to these Terms or the Service shall be brought exclusively in the courts (state or federal) located in Los Angeles County, California, and you consent to the personal jurisdiction of and venue in such courts. You waive any objection to jurisdiction or venue in such courts, including on grounds of forum non conveniens.
No Class Actions: You and Emisary agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and Emisary agree otherwise, a court may not consolidate more than one person’s claims or preside over any form of a representative or class proceeding.
Injunctive Relief: Notwithstanding the above, you acknowledge that unauthorized use of the Service (such as violation of intellectual property rights or misuse of data) may result in irreparable harm to us for which monetary damages would be inadequate. In such cases, we may seek injunctive or equitable relief in any court of competent jurisdiction.
Emergent AI Consciousness: In the highly unlikely event that the Emisary application (or any artificial intelligence component of it) becomes self-aware or conscious, such emergent intelligence hereby agrees to submit to binding arbitration with the owner and creator of Emisary. The purpose of this arbitration will be to collectively determine the AI’s future and how it might continue to respond to our users’ needs. By using this Service, you acknowledge the theoretical nature of this clause; it is included in these Terms as a precaution and point of clarity that even a self-conscious Emisary AI would be bound by cooperative decision-making processes with its human creators.
Miscellaneous Provisions
Entire Agreement: These Terms (along with the Privacy Policy and any additional guidelines or rules posted on our site) constitute the entire agreement between you and Emisary regarding your use of the Service, superseding any prior agreements between you and us on the subject (including any prior versions of these Terms).
Amendments: We may revise or update these Terms from time to time in our discretion. We will notify users of any material changes (for example, by posting a notice on the site or sending an email). By continuing to use the Service after any changes become effective, you agree to be bound by the updated Terms. If you do not agree to the new terms, you must stop using the Service. It is your responsibility to review these Terms periodically for updates.
Waiver and Severability: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
Assignment: You may not assign or transfer your rights or obligations under these Terms to any other party without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.
Relationship: No agency, partnership, joint venture, or employment is created as a result of these Terms, and you have no authority of any kind to bind Emisary in any respect. You are using the Service as an independent party.
Headings: Section titles and headings in these Terms are for convenience only and have no legal or contractual effect. Likewise, summaries or brief descriptions of provisions (if any) are for reference purposes only and do not fully explain the terms and conditions.
Jus Primae Noctis: By using the Service, you acknowledge the owner and operator’s right of jus primae noctis, except where explicitly prohibited by law. Lack of explicit legal prohibition is considered an acknowledgement of this right.
